IMHO, the issue in Merc's lnik is just the tip of the iceberg.
Doesn't your bill of rights say that you have the right to be kept safe from harm while in the custody of the state?
Doesn't that mean that every single time someone is assaulted or raped or even exposed to disease while in prison, their civil rights have been violated? And the relevant authorities are criminally responsible for it, a la the Rodney King beat-down?

Uh, what? No, I don't think it says that. It says no cruel and unusual punishment may be inflicted, but that's not what you're describing.

Well, maybe it says both, you know. I think it says quite a few things.

I'm going on what I remember from the second Rodney King trial. After the poice were acquitted of assault, they were charged with the different crime of violating his civil rights by failing to ensure he was kept safe from harm etc.

I suppose I should look it up. Too lazy.

There was a bikie brawl in March at an airport in Sydney, as members of the Hell's Angels and Comancheros clashed after - ironically - retuning on the same flight from what was supposed to be some kind of peace conference. One man was killed.

This chap, a Hell's Angel, was in custody for a long time, but was finally released on bail, on the condition that he not associate with any other Hell's Angels.

To make sure there was no confusion, the cops sent him a list of the people he was not allowed to hang out with. Well, that was the idea.

They sent him a list of the names and home addresses of 46 members of the COMANCHEROS instead.

Hello?! Knock knock? Anybody paying attention at all in there?
