Looks like a lass to me. A lass with tomboyish goth fashion (pretty much the kind of fashion that used to appeal to me as a teenager) and grungy hair - not all girls treat their long hair better.
It's quite possibly a lad - but to me it looks more like a lass. The way they're sitting - posture and demeanor looks female.
