I got a check for 170. the other day from a bank of america settlement. I've never banked with them to my knowledge, though maybe they were DBA something else like WAMU or something, who knows?

Anyway, I vaguely remember getting something in the mail about a year ago asking me if I wanted to opt out of a settlement. If I wanted in all I had to do was nothing, as I recall. I still think it was WAMU or Chase or something, but then again, I didn't really pay attention.

So I was thinking I would cash the check but I noticed under my name was another name of someone else whom I've never heard of, with POD before it. (same surname as me)

Now I wonder if this guy and his old lady are somewhere out there waiting for their 170. and this is some sort of cock up that is slighting them. Or is it a cock up that was meant for me?

I have not been trying to convince myself that it is my windfall, but when I tried to contact the administrators of the settlement I got a typical prerecorded message that gave me no options to speak to a live person and no email contact on their FAQ website, just a snail mail address. I am not going to bother with sending them snail mail.

I could just toss the check or I could cash it and add it to the widows and orphans fund.

Feeling ambivalent, though I could use 170., I don't really feel like it's mine and I can't find the similarly named folks on the check.

The check is void in a couple of weeks.

The bank won't take it back, so your choices look like cash it and give it to charity, cash it and keep it, or trash it. Seems silly to trash it.

If you can't locate the other people and the company is not easily contactable, given that the check will run out in days if you don't cash it: cash it and treat yourself. You've had a hell of a year, man.

Yeah, even if you can't find the rightful owners, better to take the money from the bank than let them keep it by not cashing the check. Bank of America are nothing but a bunch of fucktards.

Just looked up POD on checks ... looks like it either means 'point of deposit', which isn't really relevant anymore, or 'payable on death'. That implies that the secondary beneficiary would be the second person named, who has your surname.

Give us a nod as to how things went. Hopefully* you're $170 to the good.

(*'Hopefully' has finally been acknowledged as correct in the above usage, in addition to its original meaning as an adverb. I still get minor chest pain when I use it this way, but I'm trying to break myself in slowly.)
