That's what they get when they choose to let a Supreme Court legislate from the bench through its interpretation of the Constitution and its protections rather than Amending the Constitution to eliminate multiple interpretations. They don't complain about it when it works to their advantage even if some have to stockpile the Plan B pill or others have to stockpile ammunition. That's why they maintain the status quo. It may not be what they deserve; but, it's what they bargained for. Can you imagine if the women's right to vote was based on a Supreme Court decision rather than an Amendment. The margin for McConnell in the Senate to get Trump's SCOTUS nominee appointed is narrowing. There are 53 Republican Senators and two of them, Collins of Maine and Murkowski of Alaska, have indicated that they will not vote to seat a new justice before the election.
That leaves 51 Senators for McConnell. It's possible, even likely, that Romney of Utah will not vote to confirm a new justice in this circumstance, bringing the total to 50. As we all know, Pence is the President of the Senate. In the case of a tie, he is permitted to vote.
