Obama has already publicly stated that he wouldn.t do a third term as President even if he could and that he's not interested in a Supreme Court appointment either.

At first I thought you meant the Senate would need to vote on whether Scalia was actually dead...

I don't know, we say "this close" but it's still 9 months away. And the Senate might take the devil they know over the possibility of the Democrats retaking the senate after the election. Say, Bernie as president, plus a Democratic Senate: current Republican senators can't possibly like the kind of nominee that would bring about.

There's clear precedence from repubicans who nominated Supreme Court Justices in their last year of a term. Reagan nominated Kennedy in February of '88, Ford nominated Stevens in December '75, Nixon / Renquist and Powel in December '71. It's hypocritical for them to suggest that Obama delay. But it's typical.

Eleven months. Obama is president until January 20.

The new senate takes office January 3. But that may not be too meaningful, since a filibuster would almost certainly be possible no matter how the election goes.

The kid brought a ticking clock into school to countdown the event. Teacher immediately knew it must be a bomb. Cops were called. The kid was hauled off in handcuffs.

Once upon a time, this would have been fiction. Politics is dangerous at any age. Even Scalia couldn't take it anymore - and clocked out.
