There's masturbating, and then there's masturbating. Everybody in that setting knows where the cameras are, and how to engage in, um, private activities. Without seeing the tapes, I suspect that the inmate engaged in a performance for the camera as much as for his own pleasure.
This would be a bigger story if the guard had been observing the inmate directly, rather than just on the camera system. More opportunity for harassing language from the inmate to the guard, for example.
And don't forget, in a prison environment, semen is a missile weapon.
The criminal suit may be the stepping stone for the guard to sue for damages against the prison, because certainly the inmate hasn't got squat.
