DES MOINES, Iowa (AP) - A Colorado man was arrested Tuesday in central Iowa after authorities discovered almost 700 pounds of marijuana in his vehicle -- a street value of about $2 million, officials said.

Michael Suitt, of Centennial, was charged with possession with intent to deliver marijuana and failure to affix drug tax stamp, according to the Dallas County Sheriff's Office.

That's in case they can't nail you with intent or conspiracy, the tax stamp is a gotcha they don't need a jury for.

Drug Tax Stamp
The fact that dealing marijuana and controlled substances is illegal does not exempt it from taxation. Therefore drug dealers are required by law to purchase drug tax stamps.

The drug tax is due as soon as the dealer takes possession of the marijuana or controlled substance. Payment of the drug tax will purchase the drug tax stamps. Attach the stamp to the marijuana and/or controlled substance immediately after receiving the substance. The stamps are valid for 3 months. Drugs seized without stamps or having expired stamps may result in criminal or civil penalties which may include fines, seizure of property or liens against real estate.

A dealer is not required to give his/her name or address when purchasing stamps and the Department is prohibited from sharing any information relating to the purchase of drug tax stamps with law enforcement or anyone else.

Purchasing drug tax stamps does not make possession of drugs legal.

Many people want to legalize, regulate, and tax marijuana and other drugs, however, few know that many U.S. states are content simply to tax. In fact, even the federal government wants a share (middle of p. 89 of the PDF), and used tax stamps in early prohibition, but only the states have recently issued issued cool stamps (be sure to click "exhibit"). The point, of course, is not to actually tax the drugs, but to penalize the drug dealers for tax evasion as well as drug sales. They have brought in some money, though. A few interesting state government pages: Conecticut, Nebraska, North Carolina and their tax return form, and Kansas.

Seems like there'd be a lawyer somewhere crafty enough to construct a case that taxing something implicitly voids its statutory prohibition.

But, on the other hand, the lawyers inclined to argue such are probably all too busy watching reruns of the Smurfs.

Yeah, I was a 'kid' when the legislation went thru here in IA regarding the tax stamp on drugs, with much the same reactions as have been posted here.

Bottom line, one more way to squeeze a few more bucks out of the possesor when caught, and I think add to their sentance if jail time is given.

Don't have the time today to look up details, but Bruce and Merc did a good job regarding other states.
