Small point of order, you wouldn't have the right of way. By definition, pedestrians
always have the right of way, even if they're jaywalking.
Actually, now that I think about it, I can only say for certainty that this is true in Texas. But I bet it's true everywhere. You can't have a law that even implies it might be okay to hit someone in certain circumstances. Better to make it always illegal, and then use legal discretion to
not bring charges against the driver when it was clearly unavoidable.
