Just because Congress approved the Act doesn't mean they currently do. Do you really think that would pass now (Ok, maybe now, but after the elections)? The only reason it did then was the immediately-post-September 11th climate generally did not allow a congressman to not vote for anything with the word "Patriot" in the title. And yeah, that law is a pile of crap that courts are throwing out parts of seemingly every other week.
