I assume they're also counting material older than 17 years that would be in the public domain by now if the RIAA et al hadn't subverted U.S. copyright laws in order to reap a perpetual windfall from same?

What copyright laws apply really depend on when it was originally written/produced/etc. There is stuff still out there under the pre-1976 changes that is still protected. Thanks to Sonny Bono and Mickey Mouse, copyrights seem to go on and on and on and on.
