Here is link to the story. who was at fault? both actually. the driver of the SUV for not stopping and looking both ways and the pilot for coming in too low. it's arguable about his low approach. i fly a low approach quite often. but never when there is a road on the approach end of the runway. i'll make sure i have at least a 50' clearance if so and land a tad long. |
I'm not a lawyer. But that looks like 100% pilot error from here. Maaaaybe there's a traffic signal on the road saying, planes have the right of way, but I've never seen one. The car's on the road, where cars belong. The plane's in the air, but where cars go. If the car had been on the runway, different story. Doesn't look like that from here though. I like the dialog "you pulled out in front of a plane!" wtf? A plane? I remember being trained to look for the kid chasing the ball from between parked cars but not being attacked from the sky.

I can see your point of view on this but anytime a road passes in front of a runway threshhold the plane has the right of way. Driver, in this case, is an avid visitor of the airport there and should have known to look both ways before crossing the approach path. Meh, i still say they were both at fault. I will pull out the FAR's and have a look...(faa regs) |

Oh, i did find an advisory circular from the FAA but it had to do with vehicles operating on the airport for the airport. Any rate...it did say all planes have the right of way unless otherwise specified by air traffic control (with operations at a towered airport) |

If the kid jumped out from between cars, I'd fucking dynamite the brakes--despite the fact that I have the right of way (assuming I did have the right of way). Not only am I not a lawyer, I am no pilot either (though I do have a new honorific, TBA) but that just looked like he came in too low. I just don't know that I'd be thinking, "Ooooh, better watch out for airplanes."

I think the car was most at fault but I don't know what the legalities are about stop signs on private roads, especially when it's painted on the road instead of the normal octagon. I found out in PA the cops can ticket you for blowing a stop sign in a mall parking lot.:eek:
